If you’re a victim of a violent crime or struggling with grief, depression, or other hardships, you can feel stuck, unsure of what to do next. The Irving Family Advocacy Center is available to assist anyone who lives, works, or goes to school in Irving. The Center also serves anyone who has been a victim of a violent crime in Irving.
If you are a victim of a violent crime, your right to be informed and participate in all critical stages of the criminal justice process related to that crime is guaranteed by the Texas Code of Criminal Procedure, Chapter 56A.051We hope this resource guide will provide you with helpful information during a difficult time.

The Texas Code of Criminal Procedure, Chapter 56A.051, guarantees certain rights to victims of crime in the criminal justice system. Staff are available at the police department, district attorney’s office, or a supervising agency such as probation or parole to aid crime victims. Below is a summary of the rights afforded to crime victims. The full rights can be viewed online at https://statutes.capitol.texas.gov.
1. Adequate protection from harm and threats of harm arising from cooperation with prosecution efforts.
2. Victim safety considered in setting bail.
3. Notification of relevant court proceedings (upon request).
4. Information about the defendant’s right to bail and procedures in criminal investigations (upon request).
5. Provide pertinent information to probation department.
6. Receive information about Crime Victims’ Compensation and payment for a medical exam for a victim of sexual assault.
7. Be informed about parole procedures (upon request).
8. Separate or secure waiting area at public court proceedings.
9. Prompt return of property that is no longer needed as evidence.
10. Attorney notification to employer of need for cooperation or testimony in proceedings.
11. Request victim-offender mediation.
12. Be informed of the uses of a victim impact statement.
13. For certain offenses, have court consider impact of a continuance on a victim.
14. For certain offenses, explanation of defense-initiated victim outreach.
It is a crime for any person to cause you any physical injury or harm EVEN IF THAT PERSON IS A MEMBER OR FORMER MEMBER OF YOUR FAMILY OR HOUSEHOLD
Please tell the investigating peace officer:
If you, your child, or any other household resident has been injured; or If you feel you are going to be in danger when the officer leaves or later.
You have the right to:
Ask the local prosecutor to file a criminal complaint against the person committing family violence; and Apply to a court for an order to protect you (you should consult a legal aid office, a prosecuting attorney or a private attorney). If a family or household member assaults you and is arrested, you may request that a magistrate’s order for emergency protection be issued. Please inform the investigating officer if you want an order for emergency protection. You need not be present when the order is issued. You cannot be charged a fee by a court in connection with filing, serving, or entering a protective order. The court can enter an order that:
1) the abuser not commit further acts of violence;
2) the abuser not threaten, harass, or contact you at home;
3) directs the abuser to leave your household; and
4) establishes temporary custody of the children and directs the abuser not to interfere with the children
or any property.
A VIOLATION OF CERTAIN PROVISIONS OF COURT-ORDERED PROTECTION (such as (1) and (2) above) MAY BE A FELONY.

You have the right to:
1. obtain a forensic medical examination within 120 hours of the assault to collect potential evidence and receive preventative medications, even if you decide not to make a report to a law enforcement agency;
2. anonymously track or receive updates regarding the status and location of each item of evidence collected in your case;
3. have a sexual assault program advocate present during a forensic medical examination;
4. have a sexual assault program advocate or other victim’s representative present during an investigative interview with law enforcement;
5. ask the local prosecutor to file a criminal complaint against the person who assaulted you; and
6. if a defendant is arrested for a crime against you involving certain sexual crimes, stalking, or trafficking, you can:
A. request an order for emergency protection to be issued by a magistrate; and
B. apply to a court for a permanent order to protect you (you should consult a legal aid office, a
prosecuting attorney, or a private attorney).
For example, the court can enter an order that prohibits the person who assaulted you from:
1. committing further acts of violence;
2. threatening, harassing, or contacting you or a member of your family or household; and
3. going near your place of employment or near a child care facility or school attended by you or a member
of your family or household.
You cannot be charged a fee by a court in connection with filing, serving, or entering a protective order.

A victim of a violent crime has the right to receive information regarding compensation that may be available through programs such as the Crime Victims’ Compensation program. This program can provide benefits for expenses that are directly related to the crime to include medical or dental expenses, loss of support, lost wages, funeral expenses, counseling services, crime scene clean-up, travel, child-care, relocation assistance and replacement of seized property. Each benefit has a maximum payout with the total compensation limited to $50,000. To be eligible for the Texas Crime Victims’ Compensation program, an individual must be a victim of violent crime that has been reported and the victim must be cooperative in the investigation and prosecution of the case.
